Therefore, employees need to pay attention to the benefits and regimes they are entitled to, such as how many days of annual leave do they get? How is the salary paid for annual leave? If not taking a break, can an employee get paid? When the employees quit the job without taking the full number of annual leave days, will they be paid for such days?<\/span><\/p>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter size-full wp-image-2688\" src=\"https:\/\/pl-partners.vn\/wp-content\/uploads\/2021\/10\/cach-tinh-phep-nam_eng.jpg\" alt=\"\" width=\"1000\" height=\"700\" srcset=\"https:\/\/pl-partners.vn\/wp-content\/uploads\/2021\/10\/cach-tinh-phep-nam_eng.jpg 1000w, https:\/\/pl-partners.vn\/wp-content\/uploads\/2021\/10\/cach-tinh-phep-nam_eng-269x188.jpg 269w, https:\/\/pl-partners.vn\/wp-content\/uploads\/2021\/10\/cach-tinh-phep-nam_eng-768x538.jpg 768w, https:\/\/pl-partners.vn\/wp-content\/uploads\/2021\/10\/cach-tinh-phep-nam_eng-43x30.jpg 43w\" sizes=\"(max-width: 1000px) 100vw, 1000px\" \/><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #ff0000; font-family: arial, helvetica, sans-serif;\"><strong>The number of leave days when working full 12 months<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif; color: #333333;\">Article 113 of Labor Code 2019 stipulates<em>: <\/em>Any employee who has been working for an employer for fully <strong>12 months<\/strong> is entitled to<strong>\u00a0annual leave<\/strong>, which is stipulated in his\/her employment contract as follows:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: arial, helvetica, sans-serif; color: #333333;\">For employees who work in normal working conditions: 12 working days.<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif; color: #333333;\">For employees that are minors, the disabled, employees who do heavy, hazardous, or dangerous work: 14 working days.<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif; color: #333333;\">For employees who do highly heavy, hazardous, or dangerous work: 16 working days.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif; color: #333333;\">Subject to seniority, the annual leave of an employee shall increase by 01 day by every <strong>05 years<\/strong> of employment. An employee may reach an agreement with the employer on taking annual leave in installments or combining annual leave over a maximum period of up to 03 years.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #ff0000; font-family: arial, helvetica, sans-serif;\"><strong>The number of leave days when working <\/strong><strong>less than<\/strong><strong> 12 months?<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif; color: #333333;\">When the employee has been working for less than 12 months, he\/she is still entitled to certain paid leave days <strong>proportional to the number of working months<\/strong>.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif; color: #333333;\"><strong>Periods included in working time as the basis for calculation of annual leave<\/strong>: <em>(<\/em><em>Legal basis<\/em><em>: Article 65 Decree 145\/2020\/ND-CP)<\/em><\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: arial, helvetica, sans-serif; color: #333333;\">Vocational training and apprenticeship period if the employee keeps working for the employer after the end of the vocational training or apprenticeship period;<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif; color: #333333;\">Probation period if the employee keeps working for the employer after the end of the probation period;<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif; color: #333333;\">Personal fully-paid leave;<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif; color: #333333;\">Unpaid leave if accepted by the employer and not exceeding 01 month per year in total;<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif; color: #333333;\">Leave taken due to occupational accidents or diseases if not exceeding 6 months in total;<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif; color: #333333;\">Sick leave if not exceeding 02 months per year in total;<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif; color: #333333;\">Maternity leave;<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif; color: #333333;\">Period of performing duties of the employees&#8217; representative organization at grassroots level that is included in working time;<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif; color: #333333;\">Suspension and leave through no fault of the employee;<\/span><\/li>\n<li><span style=\"font-family: arial, helvetica, sans-serif; color: #333333;\">Suspension period after which the employee is exonerated or exempt from disciplinary actions.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif; color: #333333;\">*** In case a worker has not worked for a full month, if his\/her total number of working days and paid leave days (public\/New Year holidays, annual leave, paid leave for personal business) account for 50% or more of the agreed normal working days in a month, that month shall be regarded as a full working month for calculating the annual leave days.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #ff0000; font-family: arial, helvetica, sans-serif;\"><strong>HOW TO CALCULATE ANNUAL LEAVE<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff; font-family: arial, helvetica, sans-serif;\"><strong><em>* <\/em><\/strong><strong><em>Working less than 12 months<\/em><\/strong><strong><em>:<\/em><\/strong><\/span><\/p>\n<table style=\"width: 100%; border-collapse: collapse; background-color: #d3f5f1;\">\n<tbody>\n<tr>\n<td style=\"width: 697px;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Annual leave = the number of annual leave + the number of additional leave days subject to seniority <em>(if any)<\/em> \/ 12 x the actual number of working months in the year<\/span><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif; color: #333333;\">In which:<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif; color: #333333;\">&#8211; The number of annual leave of employees is from 12 to 16 days depending on working conditions and working subjects.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif; color: #333333;\"><em>For example: In 2020, Mr. <\/em><em>B<\/em><em> has worked for company <\/em><em>ABC<\/em><em> in normal working condition for <\/em><em>03<\/em><em> months<\/em><em>, excluding 02 months of probation. <\/em><em>Accordingly, <\/em><em>t<\/em><em>he number of working months of Mr. B is <\/em><em>0<\/em><em>5 months<\/em><em>. Thereby,<\/em><em> we can determine the number of annual leave of Mr. B as follows:<\/em><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif; color: #333333;\"><strong>T<\/strong><strong>he number of annual leave<\/strong><strong>\u00a0= 12 days \/ 12 x 5 months = 5 days<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff; font-family: arial, helvetica, sans-serif;\"><strong><em>* <\/em><\/strong><strong><em>Working for full 12 months:<\/em><\/strong><\/span><\/p>\n<table style=\"width: 100%; border-collapse: collapse; background-color: #d3f5f1;\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Annual leave = the number of annual leave + the number of additional leave days subject to seniority <em>(if any)<\/em><\/span><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif; color: #333333;\"><em>For example: Mr. <\/em><em>C<\/em><em> has worked for company <\/em><em>ABC<\/em><em> under normal conditions since <\/em><em>December <\/em><em>201<\/em><em>5<\/em><em>.
