So, does the law allow the parties to change the mortgaged property? Let&#8217;s learn about this issue with PL &amp; Partners through the following article.<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"color: #282828;\"><span style=\"color: #0000ff;\">Article 317 of the\u00a0 Civil Code 2015<\/span> provides:<\/span><\/p>\n<table style=\"width: 100%; border-collapse: collapse; border-color: #00000; background-color: #faecd7;\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\"><span style=\"color: #282828;\"><em>\u201cMortgage is a security interest for the performance of an obligation, one party shall use its own property to secure the performance of the obligation and shall not deliver the property to the other party.\u201d<\/em><\/span><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"color: #282828;\">And pursuant to <span style=\"color: #0000ff;\">Article 321 of the Civil Code 2015<\/span> stipulating the rights of the mortgagor, including the rights to: sell, <strong>replace<\/strong>, or exchange the mortgaged property, <strong>if such property is a commodity circulated<\/strong> <strong>in the process of production and business<\/strong>. In this case, the right to demand payment from the buyer, the proceeds, the property formed from the proceeds, and the replaced or exchanged property becomes the mortgaged property.<\/span><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"color: #282828;\">For example: Company M borrows money from Bank T, and the collateral for the loan is the volume of goods Company M produces.
