Usually, people will mortgage at credit institutions but many still wonder whether individuals can receive mortgages of real estate or not.<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"1_First_it_is_necessary_to_understand_what_a_mortgage_is\"><\/span><span style=\"color: #ed1c24;\"><strong>1. First, <\/strong><strong>it is<\/strong><strong> necessary to understand what <\/strong><strong>a<\/strong><strong> mortgage<\/strong><strong> is.<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Article 317 of the Civil Code 2015 stipulates: <strong><em>Mortgage means the use of property by one party under its ownership (hereinafter referred to as the mortgagor) to secure the performance of an obligation without handing over the property to the other party (hereinafter referred to as the mortgagee). <\/em><\/strong><strong><em>The Parties may assign a third party to hold the mortgaged property upon mutual agreement<\/em><\/strong><strong><em>.<\/em><\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Pursuant to Article 179 of the 2013 Land Law, households, and individuals <strong><em>are entitled to<\/em><\/strong><strong><em> mortgage land use rights and land-attached assets<\/em><\/strong> at credit institutions licensed to operate in Vietnam, other economic organizations, or <em>to<strong> individuals <\/strong><\/em>as prescribed by law.\u201d<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">From the above regulations, it can be seen that, <strong><em>Individuals are allowed to<\/em><\/strong><strong><em> receive<\/em><\/strong> <strong><em>the <\/em><\/strong><strong><em>mortgage <\/em><\/strong><strong><em>of <\/em><\/strong><strong><em>land use rights and house ownership from individuals<\/em><\/strong>. Your friend\u2019s opinion that we can only mortgage property at credit institutions is incorrect.<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"2_Mortgaging_real_estate_shall_be_made_into_a_contract_and_shall_be_notarized_certified\"><\/span><span style=\"color: #ed1c24;\"><strong>2. Mortgag<\/strong><strong>ing<\/strong><strong> real estate <\/strong><strong>shall<\/strong><strong> be made into a contract and <\/strong><strong>shall<\/strong><strong> be notarized<\/strong><strong>, certified.<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Pursuant to Article 167.3 of the Land Law 2013: \u201cContracts on transfer, donation, mortgage and capital contribution of land use rights, ownership of houses and properties attached to land <strong><em><u>must be notarized<\/u><\/em><\/strong><strong><em><u>,<\/u><\/em><\/strong><strong><em><u> or <\/u><\/em><\/strong><strong><em><u>certified<\/u><\/em><\/strong>, except for the case of real estate business specified at Point b of this Clause\u201d. Accordingly, when an individual mortgages land use rights, ownership of houses and other assets attached to land, a contract must be drawn up and must be notarized or certified.<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"3_Mortgage_of_real_estate_is_required_to_be_registered\"><\/span><span style=\"color: #ed1c24;\"><strong>3. M<\/strong><strong>ortgage<\/strong><strong> of real estate<\/strong> <strong>is<\/strong><strong> required to be registered<\/strong><strong>.<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Pursuant to Article 319.1 of the Civil Code 2015, a mortgage contract shall take effect from the time it is signed, unless otherwise agreed upon or otherwise provided by law.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">As for the mortgage of land use rights, Article 188.3 of the Land Law 2013 clearly stipulates:<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">\u201c<em>The <\/em><em>exchange<\/em><em>, transfer, lease, sub-lease, inheritance, donation, mortgage of land use rights or capital contribution <\/em><em>of<\/em><em> land use rights<\/em> <strong><em>shall<\/em><\/strong><strong><em> be registered at the land registration agency and take effect from the date of registration in the cadastral book\u201d.<\/em><\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Thus, the mortgage of land use rights must be registered at the land registration agency (Land Registration Authority) and takes effect from the time of registration in the cadastral book.<\/span><\/p>\n<p style=\"text-align: justify;\"><em><strong><span style=\"color: #ed1c24;\">***Some notes when implementing regulations on the mortgage of land use rights and house ownership by individuals.<\/span><\/strong><\/em><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Pursuant to Article 188.1 of the Land Law 2013: Land users may exercise the rights to mortgage land use rights when meeting the following conditions:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\">Have a certificate;<\/span><\/li>\n<li><span style=\"color: #000000;\">There is no dispute over the land;<\/span><\/li>\n<li><span style=\"color: #000000;\">The land use right is not distrained for judgment enforcement;<\/span><\/li>\n<li><span style=\"color: #000000;\">Land use term still remains.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Article 119.1 of the Law on Housing 2014 stipulates the conditions for mortgaging housing:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\">Being the house owner or the person authorized by the owner to carry out transactions on housing;<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">For individuals, they must have full civil act capacity to conduct transactions on housing.<\/span><\/p>\n<table style=\"width: 100%; border-collapse: collapse; background-color: #e3f1fa;\" border=\"1\/2pt\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\">\n<ul>\n<li style=\"text-align: justify;\"><span style=\"color: #0000ff; font-size: 16px;\">The above-mentioned consulting opinions are based on the provisions of the law and information provided by the client.
