IN WHAT CASES CAN THE COMPANY DEDUCT EMPLOYEES&#8217; SALARIES?<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Pursuant to <span style=\"color: #0000ff;\">Articles 102 and 129 of the 2019 Labor Code<\/span>, the company is only allowed to deduct the employees\u2019 salaries in the following cases:<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><u>Case 1:<\/u> The employee <strong>damages<\/strong> equipment, tools, or has other acts that create property damage.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong><em>Note:<\/em><\/strong><em> In case the employee, due to negligence, causes minor property damage having a value not exceeding 10 months of the regional minimum wage announced by the Government applicable at the employee\u2019s workplace, the employer shall receive a maximum of 03 month\u2019s salary compensation and the deduction shall be made monthly pursuant to Article 102.3 of the 2019 Labor Code.<\/em><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">The monthly deduction must not exceed 30% of the employee&#8217;s actual monthly salary after all the compulsory social insurance, health insurance, unemployment insurance, and personal income tax are deducted.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><u>Case 2:<\/u> The employee <strong>loses<\/strong> tools, equipment, property of the employer or other property handed over by the employer.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><u>Case 3:<\/u> The employee <strong>consumes<\/strong> materials in excess of the allowed norm.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong><em>Note:<\/em><\/strong><em> Employees are not required to compensate in case of natural disasters, fires, enemy sabotage, dangerous epidemics, disasters, objective events that cannot be foreseen and cannot be remedied even though they have taken all necessary and permissible measures.<\/em><\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"2_PENALTIES_FOR_ILLEGAL_SALARY_DEDUCTIONS\"><\/span><span style=\"color: #003366;\"><strong>2.
