Therefore, once a dispute arises between the parties, the law allows employees to strike.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">However, many employees still do not thoroughly understand the legal regulations, which leads to many illegal (wildcat) strikes and seriously affects the legitimate rights and interests of employees themselves. Therefore, in this article, PL &amp; Partners Law Firm would like to introduce the provisions on a lawful strike. WHAT IS A STRIKE?<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">The concept of a strike is specified in <span style=\"color: #0000ff;\">Article 198 of the Labor Code 2019<\/span> as follows:<\/span><\/p>\n<table style=\"width: 100%; border-collapse: collapse; border-color: #000000; background-color: #faecd7;\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\"><span style=\"color: #000000;\">\u201cA strike is a temporary, voluntary, and organized stoppage of work by employees in order to achieve their requirements in the process of settling labor disputes. It is organized and led by the employees\u2019 representative organization which has the collective bargaining rights and is a party to collective labor disputes.\u201d<\/span><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h2><span class=\"ez-toc-section\" id=\"2_REGULATIONS_CONCERNING_A_LAWFUL_STRIKE\"><\/span><span style=\"color: #003366;\"><strong>2. REGULATIONS CONCERNING A LAWFUL STRIKE?<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">For a strike to be considered lawful, the following conditions must be met:<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"21_Employees_are_entitled_to_go_on_strike\"><\/span><span style=\"color: #ed1c24;\"><strong>2.1. Employees are entitled to go on strike.<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">The first condition for a strike to be considered lawful is to fall into one of the cases where the law allows employees to strike. <span style=\"color: #0000ff;\">Article 199 of the Labor Code 2019<\/span> provides for 02 cases where employees are eligible for strike as follows:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\"><u>Case 1<\/u>: The conciliation is unsuccessful or within 05 working days from the date the labor mediator receives the request from the party that requested dispute resolution or from the competent authority but does not conduct the conciliation;<\/span><\/li>\n<li><span style=\"color: #000000;\"><u>Case 2:<\/u> The Labor Arbitration Board is not established or established but does not issue a dispute settlement decision or the employer who is the party to the dispute fails to implement the dispute settlement decision of the Labor Arbitration Board.<\/span><\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"22_The_strike_is_organized_and_led_by_a_competent_organization\"><\/span><span style=\"color: #ed1c24;\"><strong>2.2. The strike is organized and led by a competent organization.<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">A strike is only lawful if it is organized and led by the employees\u2019 representative organization which has the collective bargaining rights and is a party to the collective labor dispute. Specifically:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\">Where there is a grassroots trade union, the strike must be organized and led by the Executive Committee of Grassroots Trade Union.<\/span><\/li>\n<li><span style=\"color: #000000;\">Where there is no grassroots trade union, the strike shall be organized and led by the superior trade union at the request of the employees.<\/span><\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"23_The_strike_complies_with_the_statutory_sequence\"><\/span><span style=\"color: #ed1c24;\"><strong>2.3. The strike complies with the statutory sequence.<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">The sequence is specified in <span style=\"color: #0000ff;\">Articles 200, 201, and 202 of the Labor Code 2019<\/span> as follows:<\/span><\/p>\n<p><span style=\"color: #000000;\"><em><u>Step 1<\/u>:<\/em> Carry out a poll.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Before conducting a strike, the employees\u2019 representative organization having the right to organize and lead the strike is liable for collecting the opinions of all employees or members of the board of the employees&#8217; representative organizations that participate in the negotiations. The content and form of the poll are specified in <span style=\"color: #0000ff;\">Article 201 of the Labor Code 2019<\/span>.<\/span><\/p>\n<p><span style=\"color: #000000;\"><em><u>Step 2<\/u>:<\/em> Issue a written decision and announce the strike.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">When <strong>more than 50%<\/strong> of the people polled agree with the content of the strike, the employees\u2019 representative organization shall issue a decision to strike in writing according to the provisions of <span style=\"color: #0000ff;\">Article 202 of the Labor Code 2019<\/span>.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">At least <strong>05 working days<\/strong> before the start date of the strike, the employees\u2019 representative organization that organizes and leads the strike must send a written notice of the decision to:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\">Employers;<\/span><\/li>\n<li><span style=\"color: #000000;\">People&#8217;s Committees of districts;<\/span><\/li>\n<li><span style=\"color: #000000;\">Specialized labor agency under the provincial People&#8217;s Committee.<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #000000;\"><em><u>Step 3<\/u>:<\/em> Go on strike.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">By the time the strike shall begin, if the employer still does not accept the employee&#8217;s request, the employee&#8217;s representative organization shall organize and lead the strike.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"24_Do_not_go_on_strike_at_places_where_strikes_are_not_allowed\"><\/span><span style=\"color: #ed1c24;\"><strong>2.4. Do not go on strike at places where strikes are not allowed.<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Do not strike at workplaces where the strike may threaten national defense, security, public order, and human health.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">The list of places where strikes are not allowed is specifically listed in <span style=\"color: #0000ff;\">Appendix VI of Decree no.145\/2020\/ND-CP.<\/span><\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"25_Do_not_go_on_strike_at_the_time_the_collective_labor_dispute_is_being_resolved_by_a_competent_authority_organization_or_individual\"><\/span><span style=\"color: #ed1c24;\"><strong>2.5. Do not go on strike at the time the collective labor dispute is being resolved by a competent authority, organization or individual.<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<h3><span class=\"ez-toc-section\" id=\"26_Do_not_strike_when_there_has_been_a_decision_to_postpone_or_stop_the_strike_issued_by_the_competent_authority\"><\/span><span style=\"color: #ed1c24;\"><strong>2.6. Do not strike when there has been a decision to postpone or stop the strike issued by the competent authority.<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong><u>Thus<\/u><\/strong>, when the above 6 conditions are met, a strike is considered lawful. Failure to meet any of the above conditions is considered an illegal strike, then, the employees participating in the strike will not be paid wages for the days they go on strike and may be subject to disciplinary action. The employer may be compensated for the damage caused by them (if any).
