B HAS <\/strong><strong>DIED AND LEFT THE ESTATE TO HIS HEIRS<\/strong><strong>.<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"color: #282828;\">At this time, Mr. B&#8217;s estate will be distributed according to the will or the law (if there is no will or the will is illegal).<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #282828;\"><span style=\"color: #0000ff;\">Article 615 of the Civil Code<\/span> stipulates that: &#8220;The heirs are responsible for performing property obligations within the scope of the estate left by the decedent, unless otherwise agreed.&#8221;<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #282828;\">&#8220;<em>In case the estate has not been di<\/em><em>stributed<\/em><em>, the property obligations left by the deceased shall be performed by the administrator of the estate within the scope of the estate according to the agreement of the heirs<\/em>.&#8221;<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #282828;\"><em>\u201c<\/em><em>In case the estate has been <\/em><em>distributed<\/em><em>, each heir shall perform the property obligations left by the deceased in proportion <\/em><em>to <\/em><em>but not exceeding the <\/em><em>inheritance<\/em><em> he<\/em><em>\/she<\/em><em> has received, unless otherwise agreed.<\/em><em>\u201d<\/em><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #282828;\">Thus, in this case, You have the right to require Mr. B&#8217;s heirs to repay you within the scope of the inheritance they received from Mr. B.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #282828;\">However, you should note that the law stipulates the order of priority for payment related to estate as follows:<\/span><\/p>\n<ol style=\"text-align: justify;\">\n<li><span style=\"color: #282828;\">Funeral costs.<\/span><\/li>\n<li><span style=\"color: #282828;\">Missing alimony.<\/span><\/li>\n<li><span style=\"color: #282828;\">Expenses for estate<\/span><\/li>\n<li><span style=\"color: #282828;\">Subsidies for dependents.<\/span><\/li>\n<li><span style=\"color: #282828;\">Wages for employees.<\/span><\/li>\n<li><span style=\"color: #282828;\">Damages.<\/span><\/li>\n<li><span style=\"color: #282828;\">Taxes and other payables to the state budget.<\/span><\/li>\n<li><span style=\"color: #282828;\">Debts<\/span><\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><span style=\"color: #282828;\">Debt payment is in the 8th position. This means Mr. B&#8217;s estate will be used to pay in orders from 1 to 7. After paying for these 07 items, the heir will have to use the remaining estate to pay you (if any). The obligation to repay the debt cannot exceed the inheritance they received.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #282828;\">For example:<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #282828;\"><em>Mr. B&#8217;s estate has a total value of 600 million<\/em><em> Vietnamese<\/em><em> dong<\/em><em>s<\/em><em>. After completing the payment for 07 items in <\/em><em>order of<\/em><em> 400 million V<\/em><em>ietnamese dongs, <\/em><em>the remaining <\/em><em>value is <\/em><em>200 million<\/em><em> Vietnamese dongs<\/em><em>. <\/em><em>In that case,<\/em><em> you have the right to <\/em><em>request<\/em><em> Mr. B&#8217;s heir<\/em><em>s<\/em><em> to <\/em><em>repay you<\/em><em>.<\/em><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #282828;\"><em>Mr. B still owes you 300 million <\/em><em>Vietnamese dongs<\/em><em>, but the <\/em><em>remaining estate <\/em><em>after <\/em><em>paying for items 1 to 7 is only<\/em><em> 200 million <\/em><em>Vietnamese dongs<\/em><em>. <\/em><em>In that case, <\/em><em>the heir will only <\/em><em>have to <\/em><em>pay you 200 million <\/em><em>Vietnamese dongs <\/em><em>without the obligation to pay the exces<\/em><em>s.<\/em><\/span><\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"2_CASE_2_MR_B_HAS_DIED_BUT_LEFT_NO_ESTATE_TO_HIS_HEIRS\"><\/span><span style=\"color: #003366;\"><strong>2.
