REMOVE THE PROCEDURES FOR REQUESTING EMPLOYERS TO SEND WAGE SCALES, WAGE TABLES TO STATE MANAGEMENT AGENCIES.<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"color: #282828;\">The <span style=\"color: #0000ff;\">Labor Code 2012<\/span> stipulates that: when building the wage scales, wage tables and labor norms, the employers must send it to the district-level labor state agency where their production and business facilities are located.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #282828;\">The <span style=\"color: #0000ff;\">Labor Code in 2019<\/span> has abolished this procedure in order to reduce administrative procedures for enterprises.<\/span><\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"2_REQUIRE_THE_EMPLOYERS_TO_NOTIFY_THE_EMPLOYEES_OF_PAY_SLIP\"><\/span><span style=\"color: #003366;\"><strong>2. REQUIRE THE EMPLOYERS TO NOTIFY THE EMPLOYEES OF PAY SLIP.<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"color: #282828;\"><span style=\"color: #0000ff;\">Article 95 of the Labor Code 2019<\/span> stipulates that: For every wage payment, the employers must notify the employees of the pay slip, which clearly states the wages, overtime pay, nighttime pay, reason and amount of deduction (if any).<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #282828;\">This regulation aims to make wages transparent and prevent disputes.<\/span><\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"3_SUPPLEMENT_REGULATION_ON_REQUIRING_EMPLOYERS_TO_PAY_ACCOUNT_OPENING_FEES_WHEN_PAYING_THROUGH_BANK_TRANSFER\"><\/span><span style=\"color: #003366;\"><strong>3. SUPPLEMENT REGULATION ON REQUIRING EMPLOYERS TO PAY ACCOUNT OPENING FEES WHEN PAYING THROUGH BANK TRANSFER.<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"color: #282828;\">Previously, the <span style=\"color: #0000ff;\">Labor Code 2012<\/span> stipulates that: when paying wages through a bank account, the employers and the employees agree on fees related to opening and maintaining the account.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #282828;\">But now the <span style=\"color: #0000ff;\">Labor Code 2019<\/span> specifies that the employer is liable to pay the fees related to the account opening and wage transfer, instead of &#8220;agreed by parties&#8221; as stipulated in the\u00a0 <span style=\"color: #0000ff;\">Labor Code 2012<\/span>.<\/span><\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"4_SUPPLEMENT_REGULATIONS_THAT_EMPLOYERS_SHALL_NOT_FORCE_EMPLOYEES_TO_USE_THEIR_WAGES_TO_BUY_GOODS_AND_SERVICES\"><\/span><span style=\"color: #003366;\"><strong>4. SUPPLEMENT REGULATIONS THAT EMPLOYERS SHALL NOT FORCE EMPLOYEES TO USE THEIR WAGES TO BUY GOODS AND SERVICES.<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"color: #282828;\">This new regulation is intended to ensure the employees&#8217; rights to their wages and to overcome the situation where many enterprises deliberately force their employees to spend wages on goods and services of the employers or of other entities designated by the employers.<\/span><\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"5_ADJUST_REGULATIONS_ON_THE_WAGES_DURING_THE_SUSPENSION_OF_WORK\"><\/span><span style=\"color: #003366;\"><strong>5. ADJUST REGULATIONS ON THE WAGES DURING THE SUSPENSION OF WORK.<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"color: #282828;\">The <span style=\"color: #0000ff;\">Labor Code 2012<\/span> stipulates that the wage for suspension of work due to an objective incident is mutually agreed upon by the two parties but must not be lower than the regional minimum wage prescribed by the Government.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #282828;\">This restriction on the wages paid to the employee in all cases at the time of suspension has caused many difficulties for enterprises, especially in the cases of objective incidents such as natural disasters, fires, epidemics, etc. where the downtime is relatively long. The COVID-19 pandemic has been a clear demonstration of the great influence of an objective incident on the existence of enterprises. The provisions of <span style=\"color: #0000ff;\">Labor Code 2012<\/span> have not yet ensured the principle of protecting the legitimate rights and interests of the employer.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #282828;\">Therefore, the <span style=\"color: #0000ff;\">Labor Code of 2019<\/span> supplements that both parties shall agree on the wages during the suspension of work in the following cases:<\/span><\/p>\n<table style=\"width: 100%; border-collapse: collapse; background-color: #faecd7; border-color: #000000;\" width=\"100%\">\n<tbody>\n<tr>\n<td width=\"100%\">\n<ul>\n<li><span style=\"color: #282828;\">Due to electricity and water problems that are not the employer\u2019s fault;<\/span><\/li>\n<li><span style=\"color: #282828;\">Due to natural disasters, fires, dangerous epidemics, sabotage, relocation at the request of competent authorities; or<\/span><\/li>\n<li><span style=\"color: #282828;\">For economic reasons<\/span><\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p style=\"text-align: justify;\"><span style=\"color: #282828;\">And as follows:<\/span><\/p>\n<table style=\"width: 100%; border-collapse: collapse; background-color: #faecd7; border-color: #000000;\" width=\"100%\">\n<tbody>\n<tr>\n<td width=\"100%\">\n<ul>\n<li><span style=\"color: #282828;\">Where the suspension lasts for up to 14 working days, the agreed suspension wage shall not be lower than the minimum wage;<\/span><\/li>\n<li><span style=\"color: #282828;\">Where the suspension lasts for more than 14 working days, the wage during the work suspension shall be agreed by the two parties, providing that the wage during the first 14 days of the work suspension must not be lower than the minimum wage.<\/span><\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p style=\"text-align: justify;\"><span style=\"color: #282828;\">It can be seen that this new regulation shows the employee&#8217;s share in the employer&#8217;s difficulties.<\/span><\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"6_SUPPLEMENT_BONUS_FORM\"><\/span><span style=\"color: #003366;\"><strong>6.
