CASE<\/strong><strong>S<\/strong><strong> RELAT<\/strong><strong>ING<\/strong><strong> TO CONTRACT<\/strong><strong>S ON HOUSING<\/strong><strong>.<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Pursuant to <span style=\"color: #0000ff;\">Article 122.2 of the Law on Housing 2014<\/span>, the following cases will not be required to be notarized or certified, unless the parties wish to:<\/span><\/p>\n<table style=\"width: 100%; border-collapse: collapse; background-color: #faecd7; border-color: #000000;\">\n<tbody>\n<tr>\n<td width=\"604\">\n<ul>\n<li><span style=\"color: #000000;\">Giving charity houses.<\/span><\/li>\n<li><span style=\"color: #000000;\">Buying, selling, renting state-owned housing.<\/span><\/li>\n<li><span style=\"color: #000000;\">Buying, selling, renting social housing, resettlement housing.<\/span><\/li>\n<li><span style=\"color: #000000;\">Contributing capital that are houses having one party being an organization.<\/span><\/li>\n<li><span style=\"color: #000000;\">Leasing, lending housing, letting someone stay at or authorizing someone to manage your house.<\/span><\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"2_CASES_RELATING_TO_CONTRACT_ON_LAND_USE_RIGHTS\"><\/span><span style=\"color: #003366;\"><strong>2. CASE<\/strong><strong>S<\/strong><strong> RELAT<\/strong><strong>ING<\/strong><strong> TO CONTRACT<\/strong><strong> ON <\/strong><strong>LAND USE RIGHTS.<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Pursuant to <span style=\"color: #0000ff;\">Article 167.3.b of the Land Law 2013<\/span>, the following types of contracts are not <\/span><span style=\"color: #000000;\">required to be notarized or certified, but be notarized, certified at the request of the parties:<\/span><\/p>\n<table style=\"width: 100%; border-collapse: collapse; background-color: #faecd7; border-color: #000000;\">\n<tbody>\n<tr>\n<td width=\"604\">\n<ul>\n<li><span style=\"color: #000000;\">Contracts for lease, sub-lease of land use rights or land use rights and assets attached to land.<\/span><\/li>\n<li><span style=\"color: #000000;\">Contract for conversion of agricultural land use rights.<\/span><\/li>\n<li><span style=\"color: #000000;\">Contracts for the transfer of land use rights or land use rights and assets attached to land or assets attached to land having one party or parties to the transaction being real estate companies.<\/span><\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"3_CASES_RELATING_TO_REAL_ESTATE_BUSINESS_CONTRACTS\"><\/span><span style=\"color: #003366;\"><strong>3. CASE<\/strong><strong>S<\/strong><strong> RELAT<\/strong><strong>ING<\/strong><strong> TO REAL ESTATE BUSINESS CONTRACTS.<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Pursuant to <span style=\"color: #0000ff;\">Article 17 of the Law on Real Estate Business 2014<\/span>, the following types of contracts must be made in writing. However, its notarization, certification shall be agreed upon by the parties, not mandatory:<\/span><\/p>\n<table style=\"width: 100%; border-collapse: collapse; background-color: #faecd7; border-color: #000000;\">\n<tbody>\n<tr>\n<td width=\"604\">\n<ul>\n<li><span style=\"color: #000000;\">Contract for sale and purchase of houses and construction works.<\/span><\/li>\n<li><span style=\"color: #000000;\">Contracts for renting houses and construction works.<\/span><\/li>\n<li><span style=\"color: #000000;\">Lease option contract of housing and construction works.<\/span><\/li>\n<li><span style=\"color: #000000;\">Contract for transfer, lease, and sub-lease of land use rights<\/span><\/li>\n<li><span style=\"color: #000000;\">Contract for transfer of part of or the whole real estate project.<\/span><\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">The above-mentioned real estate business contract must be made in writing.
