WHAT IS <\/strong><strong>BONA FIDE POSSESSION<\/strong><strong>?<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Previously, pursuant to <span style=\"color: #0000ff;\">Article 189 of the Civil Code 2005<\/span> (which has expired), bona fide possession was defined as follows:<\/span><\/p>\n<table style=\"width: 100%; border-collapse: collapse; background-color: #f7e4ba;\" width=\"100%\">\n<tbody>\n<tr>\n<td width=\"100%\"><span style=\"color: #000000;\">&#8220;A person possessing property without a legal basis but in good faith is a possessor who does not know and cannot know that the possession of such property has no legal basis&#8221;.<\/span><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Currently, pursuant to <span style=\"color: #0000ff;\">Article 180 of the Civil Code 2015<\/span>, it is defined as:<\/span><\/p>\n<table style=\"width: 100%; border-collapse: collapse; background-color: #f7e4ba;\" width=\"100%\">\n<tbody>\n<tr>\n<td width=\"100%\"><span style=\"color: #000000;\">\u201cBona fide possession is possession in which the possessor has grounds to believe that he or she has the right to the property being possessed.\u201d<\/span><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Thus, compared with the old provisions in the Civil Code 2005, the Civil Code 2015 has a more specific definition of bona fide possession. You only need grounds to believe that you have the right to the property being possessed to be considered as a possessor in good faith.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #ed1c24;\"><strong>For example:<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Mr. A owed Mr. B and was sued in court. Mr. A\u2019s land was used to pay Mr. B.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">After that, Mr. A&#8217;s land was sold and transferred to Ms. C in accordance with regulations on judgment enforcement.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">So Ms.C is the bona fide possessor. The ground for her bona fide possession is the certificate of land use right which has her name on it.<\/span><\/p>\n<p style=\"text-align: justify;\"><img decoding=\"async\" class=\"aligncenter\" src=\"https:\/\/pl-partners.vn\/wp-content\/uploads\/2021\/12\/chiem-huu-ngay-tinh.jpg\" alt=\"&quot;&lt;yoastmark\" \/><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Contrary to bona fide possession is mala fide possession defined in <span style=\"color: #0000ff;\">Article 181 of the Civil Code 2015<\/span>: &#8220;Mala fide possession is possession that the possessor knows or ought to know that he or she has no right to the property being possessed.\u201d<\/span><\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"2_DISTINGUISH_BETWEEN_BONA_FIDE_AND_MALA_FIDE_POSSESSION\"><\/span><span style=\"color: #003366;\"><strong>2.
