A foreigner who is eligible for visa exemption upon entry under a unilateral visa exemption scheme must possess a passport having more than 06 months of validity;<\/span><\/li>\n<li><span style=\"color: #000000;\">Not falling into these cases of suspension from entry:<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul style=\"list-style-type: circle; text-align: justify;\">\n<li><span style=\"color: #000000;\">Those who do not meet the first condition above;<\/span><\/li>\n<li><span style=\"color: #000000;\">Under-14 children who are not accompanied by their parents, guardians, or authorized persons;<\/span><\/li>\n<li><span style=\"color: #000000;\">Those forged papers or made false declarations to obtain entry, exit, or residence papers;<\/span><\/li>\n<li><span style=\"color: #000000;\">Those who suffer mental disorders or infectious diseases that threaten the community\u2019s health;<\/span><\/li>\n<li><span style=\"color: #000000;\">Those were expelled from Vietnam within the last 03 years counting from the effective date of the expulsion decisions;<\/span><\/li>\n<li><span style=\"color: #000000;\">Those who were compelled to leave Vietnam within the last 06 months, counting from the effective date of the decisions on compelled exit;<\/span><\/li>\n<li><span style=\"color: #000000;\">For epidemic prevention and control;<\/span><\/li>\n<li><span style=\"color: #000000;\">In circumstances of natural disasters;<\/span><\/li>\n<li><span style=\"color: #000000;\">For national defense, security, or social order and safety.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"2_CONDITIONS_FOR_HOME_OWNERSHIP_OF_FOREIGN_INDIVIDUALS_IN_VIETNAM\"><\/span><span style=\"color: #003366;\"><strong>2. CONDITIONS FOR HOME OWNERSHIP OF FOREI<\/strong><strong>GN INDIVIDUALS<\/strong><strong> IN VIETNAM<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\">Foreign individuals who are allowed to enter Vietnam (<em>specifically,\u00a0 having a valid passport with entry verification by the Vietnam Immigration Department<\/em>);<\/span><\/li>\n<li><span style=\"color: #000000;\">Not entitled to diplomatic and consular privilege and immunity under the Ordinance on the privileges and immunities relating to Diplomatic Mission, Consular Posts, and Representative Offices of International Organizations in Vietnam.<\/span><\/li>\n<\/ul>\n<figure style=\"width: 1000px\" class=\"wp-caption aligncenter\"><img fetchpriority=\"high\" decoding=\"async\" src=\"https:\/\/pl-partners.vn\/wp-content\/uploads\/2021\/09\/dieu-kien-de-ca-nhan-nguoi-nuoc-ngoai-so-huu-nha-o-tai-viet-nam-01.jpg\" alt=\"\u0110i\u1ec1u ki\u1ec7n \u0111\u1ec3 c\u00e1 nh\u00e2n ng\u01b0\u1eddi n\u01b0\u1edbc ngo\u00e0i s\u1edf h\u1eefu nh\u00e0 \u1edf t\u1ea1i Vi\u1ec7t Nam\" width=\"1000\" height=\"700\" \/><figcaption class=\"wp-caption-text\"><em>Foreign individuals who want to own a house in Vietnam must be allowed to enter Vietnam and are not subject to diplomatic privileges and immunities.<\/em><\/figcaption><\/figure>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"3_FORMS_OF_HOME_OWNERSHIP_OF_FOREIGN_INDIVIDUALS_IN_VIETNAM\"><\/span><span style=\"color: #003366;\"><strong>3. FORMS OF HOME OWNERSHIP<\/strong><strong> OF <\/strong><strong>FOREIGN <\/strong><strong>INDIVIDUALS<\/strong><strong> IN VIETNAM <\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<ul>\n<li style=\"text-align: justify;\"><span style=\"color: #000000;\">Cl<span style=\"color: #0000ff;\">ause 2, Article 159 of the Law on Housing 2014<\/span> and <span style=\"color: #0000ff;\">Decree 99\/2015\/ND-CP<\/span> and <span style=\"color: #0000ff;\">Decree 30\/2021\/ND-CP<\/span> stipulate that foreign individuals can only own housing (<em>including apartments and separate houses)<\/em> in the construction and investment project of commercial housing, except for areas under management relating to national defense and security as prescribed by Vietnamese law.<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"color: #000000;\">The Ministry of National Defense and the Ministry of Public Security have the responsibility to specify the areas having national defense and security requirements in each province and send a written notification to the People\u2019s Committee of the province as the basis for directing the provincial Department of Construction to compile a list of commercial housing construction projects whose houses must not be owned by foreign entities.<\/span><\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"4_QUANTITY_OF_HOUSES_OWNED_BY_FOREIGN_INDIVIDUALS_IN_VIETNAM\"><\/span><span style=\"color: #003366;\"><strong>4. QUANTITY OF HOUSES OWNED BY FOREIGN INDIVIDUALS IN VIETNAM<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Pursuant to<\/span> <span style=\"color: #0000ff;\">Article 161 of the Law on Housing 2014<\/span>, <span style=\"color: #0000ff;\">Article 76 of Decree 99\/2015\/ND-CP<\/span><span style=\"color: #000000;\">, and<\/span> <span style=\"color: #0000ff;\">Article 29 of Circular 19\/2016\/TT-BXD<\/span>, <span style=\"color: #000000;\">the quantity of houses that may be owned by foreign entities in Vietnam is specified as follows:<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"41_For_condominiums\"><\/span><span style=\"color: #ed1c24;\"><strong>4.1. For condominiums:\u00a0<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ul>\n<li style=\"text-align: justify;\"><span style=\"color: #000000;\">Foreign entities may own <strong>up to 30%<\/strong> of the total number of apartments in an apartment building.<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"color: #000000;\">In an area whose population is equivalent to that of a ward-administrative division, if there are multiple apartment buildings for sale or lease-purchase, foreign entities may own <strong>no more than 30%<\/strong> of the number of apartments of each apartment building, and <strong>up to 30%<\/strong> of the total number of apartments of all these apartment buildings.<\/span><\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"42_For_separate_houses\"><\/span><span style=\"color: #ed1c24;\"><strong>4.2. For separate houses:<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">In an area whose population is equivalent to that of a ward-administrative division, if there is a commercial housing construction project, including separate houses for sale or lease-purchase, the quantity of separate houses that may be owned by foreign entities is specified below:<\/span><\/p>\n<ul style=\"list-style-type: circle;\">\n<li style=\"text-align: justify;\"><span style=\"color: #000000;\">If there is one project where the quantity of separate houses is <span style=\"text-decoration: underline;\">fewer than 2,500<\/span>, foreign individuals may own <strong>up to 250 houses<\/strong>;<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"color: #000000;\">If there is one project where the quantity of separate houses is <span style=\"text-decoration: underline;\">equivalent to 2,500<\/span>, foreign individuals may own <strong>up to 250 houses<\/strong> of such project;<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"color: #000000;\">If there are two or more projects in which the total number of separate houses does <span style=\"text-decoration: underline;\">not exceed 2,500 houses<\/span>, foreign individuals may own<strong> up to 10%<\/strong> of the houses of each project.<\/span><\/li>\n<\/ul>\n<div><span style=\"color: #000000;\">So, above, PL &amp;
