Pursuant to regulations, the mother will be given priority for the custody of under-36-month-old children. However, in some cases, the father still has custody of children under 36 months of age. Let&#8217;s find out right here with PL &amp; Partners Law Firm.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><span style=\"color: #0000ff;\">Article 81.2 and 81.3 of the Law on Marriage and Family 2014<\/span> stipulates:<\/span><\/p>\n<table style=\"width: 100%; border-collapse: collapse; border-color: #000000; background-color: #faecd7;\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\">\n<p style=\"text-align: justify;\"><span style=\"color: #000000; font-size: 16px;\">&#8220;<em>2. <strong>Husband and wife agree on <\/strong><\/em><strong><em>custody<\/em><\/strong><em>, <\/em><em>the <\/em><em>obligations and rights of each party after the divorce towards the child<\/em><em>ren<\/em><em>; in case no agreement can be reached, the Court shall decide to <\/em><em>grant custody of<\/em><em> the child<\/em><em>ren<\/em><em> to one party based on the child<\/em><em>ren<\/em><em>&#8216;s interests in all aspects; if the child<\/em><em>ren are<\/em> <em>from <\/em><em>07 years <\/em><em>of age<\/em><em> or older, the child<\/em><em>ren<\/em><em>&#8216;s wishes must be considered.<\/em><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000; font-size: 16px;\"><em>3. The mother shall be awarded custody of c<\/em><em>hildren under 36 months of age <strong>unless the mother <\/strong><\/em><strong><em>is<\/em><\/strong> <strong><em>in<\/em><\/strong><strong><em>eligible to directly look after, care for, nurture<\/em><\/strong><strong><em>,<\/em><\/strong><strong><em> and educate the children or the parents have other agreements in accordance with their<\/em><\/strong><strong><em> children\u2019s<\/em><\/strong><strong><em> interests.&#8221;<\/em><\/strong><\/span><\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Accordingly, it can be seen that for children under 36 months of age, the mother will be given priority over the father in child custody right, because this is the period when the children desperately need the mother&#8217;s caring hand. Therefore, when both parties agree that the father will directly raise children under 36 months of age, the law shall respect that agreement and the father shall have custody of the children. This case is common among couples who divorce in peace, they will decide for themselves who is the one to deliver the best life for their children.<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Second_Case_There_are_sufficient_proofs_that_the_mother_is_not_eligible_to_directly_raise_the_children_and_the_fathers_ability_to_custody\"><\/span><span style=\"color: #ed1c24;\"><strong>Second Case<\/strong><strong>:<\/strong> <strong>There are sufficient proofs that the mother is not eligible to directly raise the child<\/strong><strong>ren<\/strong><strong> and the father&#8217;s ability to <\/strong><strong>custody<\/strong><strong>.<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">If an agreement cannot be reached, the father will still be considered by the Court to award custody right of the children if there are sufficient grounds to prove that the mother is not eligible to directly look after, care for, nurture, and educate the child, but he is capable of raising children.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Usually, the Court determines that the mother doesn\u2019t have enough conditions to directly look after, care for, raise, and educate her children based on the following factors:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\"><em>Material conditions<\/em>: the mother&#8217;s income is unstable, she is unable to meet the children&#8217;s essential living needs; she is of no fixed abode, her address and their living environment are unhealthy, and not convenient for children to travel and study; children are not created conditions for learning and entertainment; she is raising, taking care of someone else other than the children, etc.<\/span><\/li>\n<li><span style=\"color: #000000;\"><em>Mental condition<\/em><em>s<\/em>: the mother has no time to take care of the children and has no one to help her;
