WHAT IS THE ORIGIN OF GOODS?<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Pursuant to <span style=\"color: #0000ff;\">Article 3 of Commercial Law 2005<\/span> of Vietnam, origin of goods \u201c<em>means the country or territory where the whole goods are manufactured or where the last stage of substantial processing of goods is carried out if there are many countries or territories involved in the production of that goods<\/em>\u201d.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">In addition, according to <span style=\"color: #0000ff;\">Article 3.1 of Decree No. 31\/2018\/ND-CP<\/span>, the origin of goods is also defined as follows: \u201c<em>Origin of goods means the country, group of countries or territories where the whole goods are manufactured or where the last stage of substantial processing of goods is carried out if more than one country, group of countries, or territories join in the production of the goods<\/em>\u201d.<\/span><\/p>\n<figure style=\"width: 2560px\" class=\"wp-caption aligncenter\"><img fetchpriority=\"high\" decoding=\"async\" src=\"https:\/\/pl-partners.vn\/wp-content\/uploads\/2022\/12\/xuat-xu-hang-hoa-scaled.jpg\" alt=\"Xu\u1ea5t x\u1ee9 h\u00e0ng h\u00f3a l\u00e0 n\u01b0\u1edbc, nh\u00f3m n\u01b0\u1edbc, ho\u1eb7c v\u00f9ng l\u00e3nh th\u1ed5 n\u01a1i s\u1ea3n xu\u1ea5t ra to\u00e0n b\u1ed9 h\u00e0ng h\u00f3a ho\u1eb7c n\u01a1i th\u1ef1c hi\u1ec7n c\u00f4ng \u0111o\u1ea1n ch\u1ebf bi\u1ebfn c\u01a1 b\u1ea3n cu\u1ed1i c\u00f9ng\" width=\"2560\" height=\"1707\" \/><figcaption class=\"wp-caption-text\"><em>Origin of goods means the country, group of countries or territories where the whole goods are manufactured or where the last stage of substantial processing of goods is carried out.<\/em><\/figcaption><\/figure>\n<h2><span class=\"ez-toc-section\" id=\"2_ADMINISTRATIVE_PENALTIES_FOR_ACTS_OF_ORIGIN_FRAUD\"><\/span><span style=\"color: #003366;\"><strong>2. ADMINISTRATIVE PENALTIES FOR ACTS OF ORIGIN FRAUD<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Specific penalties for violations of the origin of exports and imports are specified in <span style=\"color: #0000ff;\">Article 44 of Decree 98\/2020\/ND-CP<\/span> as follows:<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"21_A_fine_ranging_from_VND_10000000_to_VND_20000000\"><\/span><span style=\"color: #ed1c24;\"><strong>2.1. A fine ranging from VND 10,000,000 to VND 20,000,000<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">This penalty applies to the act of erasing, falsifying the Certificate of Origin or the documents of self-certification of origin or the written approvals of self-certification of origin issued by the competent authorities.<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"22_A_fine_ranging_from_VND_20000000_to_VND_30000000\"><\/span><span style=\"color: #ed1c24;\"><strong>2.2. A fine ranging from VND 20,000,000 to VND 30,000,000<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">This penalty applies to acts of providing false documents and vouchers to competent authorities, or organizations when applying for or verifying a certificate of origin.<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"22_A_fine_ranging_from_VND_30000000_to_VND_50000000\"><\/span><span style=\"color: #ed1c24;\"><strong>2.2. A fine ranging from VND 30,000,000 to VND 50,000,000<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">This penalty applies to one of the following violations:<\/span><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"color: #000000;\">a) Self-certifying the wrong origin of goods when it is approved to self-certify the origin by a competent authority;<\/span><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"color: #000000;\">b) Forging Certificates of Origin or documents of self-certification of origin in case it is not prosecuted;<\/span><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"color: #000000;\">c) Providing false documents and vouchers to competent authorities or organizations when requesting for self-certification of origin or verifying the documents of self-certification of origin.<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"23_A_fine_ranging_from_VND_50000000_to_VND_70000000\"><\/span><span style=\"color: #ed1c24;\"><strong>2.3. A fine ranging from VND 50,000,000 to VND 70,000,000<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">This penalty applies to acts of using false Certificates of Origin or false documents of self-certification of origin in case it is not prosecuted.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Simultaneously, the violator may also have the material evidence confiscated as an additional form of sanction.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">In addition, the violator shall take remedial measures:<\/span><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"color: #000000;\">a) Forcible return of illegal profits obtained from the commission of violations as mentioned above;<\/span><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"color: #000000;\">b) Forcible correction of false information about the origin of goods.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><span style=\"color: #ed1c24;\"><strong>Thus<\/strong>,<\/span> the implementation of the act of origin fraud will be subject to an administrative penalty of at least VND 10,000,000 and a maximum of VND 70,000,000. In addition to monetary fines, the subject of violations shall also be subject to the additional penalty of confiscation of material evidence and remedial measures in accordance with the law.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong><u>Note<\/u><\/strong>: The fine mentioned in the article is only applicable to individuals.
