SUBJECTS IMPLEMENTING PROCEDURES:<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"color: #282828;\">Organizations, individuals trading in one of the following goods and services have to register their model contracts and general transaction conditions:<\/span><\/p>\n<ol>\n<li><span style=\"color: #282828;\">Supplying electricity for residential consumption;<\/span><\/li>\n<li><span style=\"color: #282828;\">Supplying running water<\/span><\/li>\n<li><span style=\"color: #282828;\">Pay television;<\/span><\/li>\n<li><span style=\"color: #282828;\">Terrestrial fixed telephone services;<\/span><\/li>\n<li><span style=\"color: #282828;\">Terrestrial mobile information services (form of payment: prepaid service);<\/span><\/li>\n<li><span style=\"color: #282828;\">Terrestrial mobile information services (form of payment: postpaid service);<\/span><\/li>\n<li><span style=\"color: #282828;\">Internet access services;<\/span><\/li>\n<li><span style=\"color: #282828;\">Air transport of passengers;<\/span><\/li>\n<li><span style=\"color: #282828;\">Rail transport of passengers;<\/span><\/li>\n<li><span style=\"color: #282828;\">Purchase and sale of apartments, daily-life services provided by apartment-managing units;<\/span><\/li>\n<li><span style=\"color: #282828;\">Life insurance.<\/span><\/li>\n<\/ol>\n<h3><span class=\"ez-toc-section\" id=\"2_SEQUENCES\"><\/span><span style=\"color: #0000ff;\"><strong>2. SEQUENCES:<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ul>\n<li><span style=\"color: #ed1c24;\"><strong>Step 1:<\/strong><\/span><\/li>\n<\/ul>\n<ul style=\"list-style-type: circle;\">\n<li><span style=\"color: #282828;\"><u>In case of registration<\/u>: traders have to prepare the dossiers in accordance with the laws.<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"color: #282828;\"><u>In case of re-registration<\/u>: if there is a change in law which results in a change in the contents of the model contract, general transaction conditions; or when traders change the contents of the model contract, general transaction conditions then traders have to prepare the dossiers in accordance with the laws.<\/span><\/li>\n<\/ul>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #ed1c24;\"><strong>Step<\/strong> <strong>2:<\/strong><\/span><\/li>\n<\/ul>\n<p><span style=\"color: #282828;\">Receiving and returning results division &#8211; Department of Industry and Trade (DOIT)receives dossiers and checks the completeness of documents included in the dossier:<\/span><\/p>\n<ul style=\"list-style-type: circle; text-align: justify;\">\n<li><span style=\"color: #282828;\">In case the dossier is complete as prescribed: issuing a Receipt.<\/span><\/li>\n<li><span style=\"color: #282828;\">In case the dossier is incomplete: instructing the submitter to complete the dossier according to the law.<\/span><\/li>\n<\/ul>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #ed1c24;\"><strong>Step 3:<\/strong><\/span><\/li>\n<\/ul>\n<p><span style=\"color: #282828;\">Within 05 working days from the date of receiving the dossier, if the dossier is not valid, the Department of Industry and Trade shall send a written request to the trader to supplement the dossier.<\/span><\/p>\n<p><span style=\"color: #282828;\">Within twenty (20) working days after receiving a valid dossier, DOIT shall consider and send the trader a notice of acceptance of registration of a model contract or general transaction conditions.<\/span><\/p>\n<p><span style=\"color: #282828;\">In case of refusing such registration, DOIT shall send the trader a written reply clearly stating the reason.<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #ed1c24;\"><strong>Step 4:\u00a0<\/strong><\/span><\/li>\n<\/ul>\n<p><span style=\"color: #282828;\">Traders shall receive the results based on the appointment date on the receipt at the Receiving and Returning Results Division or can register to receive results by post.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"3_HOW_TO_SUBMIT\"><\/span><span style=\"color: #0000ff;\"><strong>3. HOW TO SUBMIT:<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"color: #282828;\">Directly sumitting or by post at \/ to Department of Industry and Trade.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"4_DOSSIERS\"><\/span><span style=\"color: #0000ff;\"><strong>4. DOSSIERS:<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"color: #282828;\">A registration dossier of a model contract or general transaction conditions comprises:<\/span><\/p>\n<ul>\n<li><span style=\"color: #282828;\">An application form (according to Appendix &#8211; Circular 10\/2013\/TT-BCT);<\/span><\/li>\n<li><span style=\"color: #282828;\">The draft model contract or general transaction conditions.<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #282828;\">Quantity of dossier: 01 (one) set.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"5_IMPLEMENTING_DURATION\"><\/span><span style=\"color: #0000ff;\"><strong>5. IMPLEMENTING DURATION:<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"color: #282828;\">Within 20 working days from the date of receipt of complete and valid documents.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"6_IMPLEMENTING_AUTHORITY\"><\/span><span style=\"color: #0000ff;\"><strong>6. IMPLEMENTING AUTHORITY:<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"color: #282828;\">Department of Industry and Trade.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"7_FEES\"><\/span><span style=\"color: #0000ff;\"><strong>7. FEES:<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"color: #282828;\">None.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"8_RESULTS\"><\/span><span style=\"color: #0000ff;\"><strong>8. RESULTS:<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"color: #282828;\">A written notice of acceptance of registration of a model contract or general transaction conditions, or a written reply clearly stating the reason.<\/span><\/p>\n<h3><span class=\"ez-toc-section\" id=\"9_REQUIREMENTS\"><\/span><span style=\"color: #0000ff;\"><strong>9. REQUIREMENTS:<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ul>\n<li><span style=\"color: #282828;\">The language is Vietnamese. The contents are clear and understandable. The font size of the text is at least 12;<\/span><\/li>\n<li><span style=\"color: #282828;\">The paper background and ink color used in model contracts and general transaction conditions must contrast.<\/span><\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"10_LEGAL_BASIS\"><\/span><span style=\"color: #0000ff;\"><strong>10. LEGAL BASIS:<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ul>\n<li><span style=\"color: #282828;\">Decree No. 99\/2011\/N\u0110-CP dated 27\/10\/2011 of the Government on detailing and guiding a number of articles of the Law on Protection of consumer rights;<\/span><\/li>\n<li><span style=\"color: #282828;\">Decision No. 02\/2012\/Q\u0110-TTg dated 13\/01\/2012 of the Prime Minister on promulgating the list of essential goods and services of which model contracts and general transaction conditions must be registered;<\/span><\/li>\n<li><span style=\"color: #282828;\">Decision No. 35\/2015\/Q\u0110-TTg dated 20\/8\/2015 of the Prime Minister on amending Decision No. 02\/2012\/QD-TTg dated 13\/01\/2012 by the Prime Minister on promulgation of essential goods and services of which model contracts and general transaction conditions must be registered.<\/span><\/li>\n<li><span style=\"color: #282828;\">Decision dated 05\/9\/2018 of the Prime Minister on amending Decision No. 35\/2015\/Q\u0110-TTg dated 20\/8\/2015 of the Prime Minister on amending Decision No. 02\/2012\/QD-TTg dated 13\/01\/2012 by the Prime Minister on promulgation of essential goods and services of which model contracts and general transaction conditions must be registered.<\/span><\/li>\n<li><span style=\"color: #282828;\">Circular No. 10\/2013\/TT-BCT dated 30\/5\/2013 of the Ministry of Industry and Trade on promulgating the application form of registration for model contracts and general transaction conditions.<\/span><\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"11_ATTACHMENTS\"><\/span><span style=\"color: #0000ff;\"><strong>11. ATTACHMENTS:<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ul>\n<li><a href=\"http:\/\/congthuong.hochiminhcity.gov.vn\/documents\/10190\/114142\/DCap_maudonhopdong.docx\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Application form (according to Appendix &#8211; Circular 10\/2013\/TT-BCT)<\/a><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>1.
